Justin Bieber faces DUI (drunk driving charges), resisting arrest charges in Miami
According to reports, Justin Beiber has been arrested for driving under the influence of alcohol and/or drugs (marijuana and antidepressants). Driving under the influence of drugs is a more difficult charge for a prosecutor to prove due to the fact that there is not set amount (measurement) at which it is per se illegal. For instance, driving under the influence of alcohol usually involves a person being allegedly over the legal limit - .08% in all states. But for a drugs only charge, there is no specified amount.
In California, it is unlawful to drive under the influence of drugs if you can no longer drive as a sober person would drive under similar circumstances. It does not matter if the drugs are prescription drugs or unlawful drugs. Usually, a police officer called a DRE or drug recognition expert, conducts the investigation. The penalties for driving under the influence of drugs can be just as severe as driving under the influence of alcohol.
