Marijuana DUI arrests are up in the San Francisco Bay Area

Now that many states have legalized marijuana for medical or recreational uses, DUI marijuana arrests and charges are more common than ever. Just because it's legal to smoke in some places, doesn't mean that it's legal to drive after smoking or while smoking.

In California, prosecutors are charging DUI marijuana cases under vehicle code section 23152(e)  which states that driving under the influence of drugs is unlawful.  /marijuana-duiHowever, to prove this charge, the prosecutor must show that the person was not operating a motor vehicle safely.
